These Terms of Service ("Terms") constitute a legally binding agreement between you and Albumzo ("Albumzo," "we," "us," or "our").

By accessing or using our services, you agree to be bound by these Terms. If you do not agree, you may not use our services.

2. Our Services

2.1 Platform Description:

Albumzo provides a cloud-based family photo and video sharing platform to:

Back up and organize your family's photos and videos
Share private and guest albums with family members
Tag and search photos using AI-assisted face recognition
Cast and stream albums to connected smart TVs
Manage family accounts, roles, and subscriptions

2.2 Free Plan and Upgrades:

New accounts start on our Free plan with no credit card required. You may upgrade to a paid plan (Premium Family or Premium Plus) at any time for additional storage, family members, and features, as described on our Pricing Page.

2.3 Service Availability:

We strive for 99.9% uptime but cannot guarantee uninterrupted service. We'll notify you of scheduled maintenance in advance.

3. Your Account and Responsibilities

3.1 Account Security:

You are responsible for maintaining the confidentiality of your password
You must notify us immediately of any unauthorized access
You are responsible for all activities under your account
You must use a strong password (minimum 8 characters, mixed case, numbers)

3.2 Accurate Information:

You agree to provide accurate, current, and complete information during registration and to update it as necessary.

3.3 Prohibited Activities:

You agree NOT to:

Use the service for illegal purposes
Attempt to gain unauthorized access
Interfere with or disrupt the service
Upload malicious code or viruses
Abuse, harass, or spam other users
Violate intellectual property rights
Share your account with others
Scrape or automatically collect data

4. Subscriptions and Payments

4.1 Free Plan:

The Free plan is available with no credit card required, subject to the storage and feature limits described on our Pricing Page.

4.2 Paid Subscriptions:

Subscriptions are billed monthly or annually in advance
Prices are displayed on our Pricing Page
All fees are exclusive of taxes (GST, VAT, etc.)
Payments are non-refundable except as required by law

4.3 Cancellation:

You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. No partial refunds.

4.4 Price Changes:

We may change prices with 30 days advance notice. Continued use after notice constitutes acceptance of new prices.

5. Intellectual Property

5.1 Our Rights:

All content, features, and functionality (software, text, graphics, logos, designs) are owned by Albumzo and protected by copyright, trademark, and other laws.

5.2 Your Rights:

You retain ownership of your photos, videos, and other content you upload. We only process it to provide our services.

5.3 License:

We grant you a limited, non-exclusive, non-transferable license to use our service for your personal and family use only.

6. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

Services are provided "AS IS" without warranties
We are not liable for indirect, incidental, or consequential damages
Our total liability is limited to fees paid in the last 12 months
We are not responsible for data loss (you should maintain backups)
We are not liable for third-party integrations or services

7. Indemnification

You agree to indemnify and hold Albumzo harmless from any claims, damages, losses, or expenses arising from:

Your use or misuse of the service
Your violation of these Terms
Your violation of any third-party rights
Your violation of applicable laws

8. Termination

8.1 By You:

You may terminate your account at any time through Settings → Delete Account. Your data will be deleted after a 30-day grace period.

8.2 By Us:

We may suspend or terminate your account immediately if you:

Violate these Terms
Engage in fraudulent activity
Fail to pay subscription fees
Use the service in a way that harms us or others

9. Dispute Resolution and Governing Law

9.1 Governing Law:

These Terms are governed by the laws of India. For EU users, local consumer protection laws also apply.

9.2 Jurisdiction:

Courts in [Your City/State], India have exclusive jurisdiction, subject to your local rights.

9.3 Arbitration (India):

Disputes will be resolved through arbitration per the Arbitration and Conciliation Act, 1996.
